Terms of Service

1. Overview

These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you," or "your") and pointzai.com ("Company," "we," "us," or "our"). By creating an account, accessing the platform at pointzai.com, or using any of our services, you agree to be bound by these Terms in full.

pointzai.com is an AI-powered lead generation platform. You describe your ideal customer profile — industry, company size, geography, target role — and our AI agents research, qualify, score, and deliver leads with verified contact details in real time. We are not a static database. Each search triggers live AI research across multiple data sources.

If you do not agree to these Terms, do not use pointzai.com.

2. Account Registration & Security

To use pointzai.com, you must create an account with a valid email address. You represent that all information you provide during registration is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility. If you suspect unauthorized access, notify us immediately at Contact Support.

One person or entity may maintain one free account. Creating multiple free accounts to circumvent credit limits is a violation of these Terms and grounds for immediate termination.

You must be at least 18 years old to use pointzai.com. By creating an account, you confirm that you meet this age requirement.

3. The Service

pointzai.com provides the following core capabilities:

• AI-Powered Lead Discovery — Describe your ideal customer in natural language. Our AI agent pipeline scans, qualifies, and scores leads from various live data sources, returning results with company details, role match, and timing signals.
• AI Scoring — Each lead receives an AI Score breakdown covering company fit, role match, and timing. Scores are indicative, not guaranteed.
• Deep Enrichment — Leads include data points such as tech stack, hiring signals, recent funding, growth trajectory, verified emails, and phone numbers where available.
• Target Audience Management — Create and manage multiple target audience profiles (subject to plan limits) to organize your prospecting.
• Pipeline Management — Track lead funnels, performance, and top performers across your audiences.
• Outreach — Send personalized emails, export leads to CSV, or connect with LinkedIn directly from the platform (features vary by plan).
• Automated Email Sequences — Available on Starter plans and above.
• AI Assistant — Available on Starter plans and above to help optimize your outreach.
• Integrations — CSV export on Starter and above; additional integrations (including HubSpot) on Growth and above.

We continuously improve and modify the Service. Features may be added, changed, or removed. We will provide reasonable notice for material changes that affect your workflow.

4. Credits, Plans & Billing

4.1 Credit System

pointzai.com operates on a credit-based system. 1 credit = 1 lead delivered. Credits are consumed when a lead result is generated and delivered to you — not when a search is initiated.

4.2 Plans

We offer four plans:

• Free — $0/month. 50 credits/month, 1 seat, up to 2 Target Audiences, verified emails & phones, advanced filters, company advanced data, 30-day lead retention.
• Starter — $29/month (or approximately $26/month billed annually). 250 credits/month. Everything in Free plus automated email sequences, AI assistant, bulk enrichment, up to 10 Target Audiences, CSV export, 90-day lead retention.
• Growth — $99/month (or approximately $90/month billed annually). 1,000 credits/month. Everything in Starter plus 5 seats included, unlimited Target Audiences, integrations (CSV + HubSpot), unlimited lead retention, dedicated support.
• Custom — Tailored for your team. Unlimited credits, unlimited seats, priority support. Contact sales for pricing.

4.3 Billing Cycle

Paid plans are billed monthly or annually in advance, in USD. Your billing cycle begins on the date you upgrade and recurs on that same date each period. Annual plans are charged as a single upfront payment covering 10 months (you receive 12 months of service — effectively 2 free months).

4.4 Credit Refresh

Credits reset at the beginning of each billing cycle. Unused credits do not roll over to the next period.

4.5 Credit Top-Up (Paid Plans Only)

Paid plan users can purchase additional credits:

• Starter: 50 additional credits for $10
• Growth: 100 additional credits for $15

Auto Top-Up is available to automatically add credits when your balance falls below a threshold. You can enable or disable Auto Top-Up at any time from your Billing settings.

4.6 Payment Methods

We accept credit and debit cards processed through our payment provider (Stripe). You authorize us to charge your payment method for all fees incurred under your account. You are responsible for keeping your payment method current.

4.7 Refunds

All charges are non-refundable except where required by applicable law. If you believe a charge is incorrect, contact us within 30 days at Contact Support.

4.8 Plan Changes

You may upgrade your plan at any time. Upgrades take effect immediately, and you will be charged the prorated difference for the remainder of your current billing cycle. Downgrades take effect at the end of the current billing period.

4.9 Invoices

Invoices are generated automatically and emailed to your account email address. Invoice history is available in your Billing settings.

5. Free Plan

The Free plan is genuinely free, forever. No credit card is required. You receive 50 credits per month, 1 seat, and up to 2 Target Audiences.

We reserve the right to modify the Free plan's feature set or credit allocation with 30 days' written notice. The Free plan is intended for individual, legitimate business use. We reserve the right to suspend accounts that we reasonably believe are abusing the Free plan (for example, by creating multiple accounts or using automated tools to circumvent limits).

6. Data Accuracy & AI Limitations

Specifically:

• AI Scores (company fit, role match, timing) are algorithmic assessments, not guarantees of lead quality or conversion.
• Contact information (emails, phones, LinkedIn profiles) is gathered from publicly available sources and verified by our systems, but may be outdated or inaccurate.
• Enrichment data (tech stack, funding, hiring signals, growth trajectory) is sourced from public information and may not reflect the most current state of a company.
• Lead counts and search results may vary. Not all searches will return the maximum number of leads.

You acknowledge that you are solely responsible for verifying the accuracy of any data before acting on it, including before initiating outreach or making business decisions based on pointzai.com data.

7. Acceptable Use

You agree to use pointzai.com only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service to send unsolicited bulk email (spam) in violation of applicable anti-spam laws including CAN-SPAM, GDPR, CASL, or equivalent local regulations.
• Use lead data for purposes unrelated to legitimate business-to-business outreach (e.g., selling, redistributing, or publishing the data).
• Scrape, crawl, or use automated tools to extract data from the Service beyond what is provided through normal use of the platform.
• Resell, sublicense, or redistribute pointzai.com data or access to any third party.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service, including our AI scoring algorithms.
• Use the Service to harass, stalk, threaten, or harm any individual or entity.
• Circumvent credit limits, usage restrictions, or any technical measures we implement.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Impersonate another person or entity when using the outreach features.
• Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.

Violation of these rules may result in immediate suspension or termination of your account without notice or refund.

8. Data, Privacy & Security

Your use of pointzai.com is also governed by our Privacy Notice, which is incorporated into these Terms by reference.

8.1 Your Data

You retain ownership of any data you input into pointzai.com (search queries, target audience configurations, notes). We use your input data solely to deliver the Service to you and to improve our AI models. We do not sell your input data to third parties.

8.2 Lead Data

Lead data generated by pointzai.com is sourced from publicly available information. You are responsible for ensuring that your use of lead data complies with all applicable data protection laws, including GDPR, CCPA, and any other local regulations. This includes obtaining any required consents before contacting individuals, maintaining proper data processing records, and honoring data subject access requests.

8.3 Lead Retention

Lead data is retained according to your plan:

• Free: 30 days
• Starter: 90 days
• Growth & Custom: Unlimited

After the retention period, lead data is permanently deleted from your account. Export your data before it expires.

8.4 Security

We implement commercially reasonable security measures including encryption of data in transit, hashed IP addresses, and secure infrastructure. We never store raw personal data beyond what is necessary to deliver the Service. However, no system is 100% secure, and we cannot guarantee absolute security.

9. Intellectual Property

The pointzai.com platform — including its design, UI, AI models, algorithms, scoring methodology, code, branding, and documentation — is owned by pointzai.com and protected by intellectual property laws. These Terms grant you no rights to our intellectual property except the limited right to use the Service as described here.

You may not copy, modify, distribute, sell, or lease any part of the Service. You may not use the pointzai.com name, logo, or branding without our prior written consent.

"pointzai.com" and associated trademarks are the property of the Company.

10. Third-Party Services & Integrations

pointzai.com integrates with third-party services including but not limited to: email delivery providers, LinkedIn, HubSpot, and Stripe for payment processing. Your use of these integrations is subject to the respective third party's terms of service and privacy policies.

We are not responsible for the availability, accuracy, or conduct of any third-party service. If a third-party integration becomes unavailable, we will use commercially reasonable efforts to provide alternatives or workarounds, but we are not liable for any loss resulting from third-party service disruptions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINTZAI.COM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of any AI-generated data or scores.

IN NO EVENT SHALL POINTZAI.COM, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to pointzai.com in the 12 months preceding the claim, or (b) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless pointzai.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, including data protection and anti-spam laws; or (d) any outreach or communications you send using data obtained through pointzai.com.

13. Termination & Account Deletion

13.1 By You

You may stop using pointzai.com at any time. You can request account deletion from your Billing settings page. Account deletion is permanent and irreversible. Upon deletion, the following data is permanently destroyed:

• All target audiences and configurations
• All generated leads and contact data
• Search history and analytics
• Team members and integrations

If you are on a paid plan, canceling your account does not entitle you to a refund for any unused portion of your billing period. Your access remains active until the end of the current billing period, after which data deletion begins.

13.2 By Us

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required by law. We will provide notice when feasible, but reserve the right to act immediately in cases of severe violation.

13.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Sections 6 (Data Accuracy), 7 (Acceptable Use), 9 (Intellectual Property), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law) survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by posting a prominent notice on the platform at least 30 days before the changes take effect.

Your continued use of pointzai.com after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and delete your account.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Tel Aviv-Jaffa, Israel.
